Uber & Lyft Insurance Policies in South Florida
Unknown to many, there are legally mandated insurance policies in place that provide benefits to Uber and Lyft drivers and their passengers when they are involved in an accident that occurs when the rideshare service is being provided. These insurance policies also provide coverage to third parties who may have been involved in an accident involving an Uber or Lyft driver.
The insurance policies that Uber and Lyft have put in place provide different levels of insurance coverage, depending on how the driver was engaged with their rideshare app at the time of the accident. These coverages are as follows:
- When the rideshare driver is not online and engaged on the rideshare app. In these cases, there no coverage provided by the rideshare company. The only insurance that will be available to you is the driver’s own personal auto insurance policy and/or your own insurance coverage.
- When the driver is online and engaged in the app, but does not have a passenger. Here the rideshare company covers the driver with $25,000 in property damage coverage and $50,000 in bodily injury coverage per person, up to a maximum of $100,000 per accident. But, this will only kick in if and when the driver’s insurance is insufficient to cover your claim.
- When the rideshare driver is transporting a passenger or en route to pick up a passenger for transport. If the accident occurs while the driver is on the way to pick up a passenger accepted through the rideshare app or when he or she is carrying that passenger, there is $1 million of liability insurance in place and another $1 million in uninsured/underinsured motorist coverage.

Rideshare drivers are required to carry their own personal liability insurance. In addition, as long as the rideshare driver was online and engaged in the rideshare app, meaning that they were either 1) online waiting for a request, 2) en route to pick up a passenger, or 3) transporting a passenger booked from the app, he or she will be covered under the rideshare company’s liability insurance policy. If not, then you will have to rely on the rideshare driver’s personal auto insurance policy.
This is important to know because, often, a driver who is responsible for causing an accident has the very minimum amount of liability insurance required by law. This means that no matter how serious your injuries and losses are, there will be little or no money to be recovered in a lawsuit. However, when an accident involves an Uber or Lyft driver, for example, an injured person can potentially recover up to a million dollars or more.
